Privacy Notice and Information Use Policies used by Localie Inc.

This document, called Privacy Policy, has the purpose of establishing the rules on the use, storage and treatment of data and information collected from USERS on the LOCALIE PLATFORM.

Responsible for USER INFORMATION: LOCALIE Inc.,

Important Definitions

DATABASE: Structured set of personal or anonymous data, located in one or several locations, in electronic or physical support;

CONSENT: It is the free, informed and unequivocal manifestation by which the USER agrees with the use of his personal or anonymous data.

CONTENTS: Any information, data, communications, software, photos, videos, graphics, music, sounds and other materials and services that can be viewed by the USERS on the PLATFORM. This includes messages, conversations, chat and other original content.

COOKIES: Files sent by the PLATFORM server to the USER’s computer, with the purpose of identifying the computer and obtaining access data, such as browsed pages or clicked links, thus allowing to personalize the use of the PLATFORM, according to its profile. They can also be used to ensure greater safety for PLATFORM USERS.

PERSONAL DATA: all data related to the natural person (identified or identifiable), non-public, relating to the identity and private life of its USER.

ANONYMOUS or ANONYMOUS PERSONAL DATA: data relating to a USER who cannot be identified.

IP (Internet Protocol): It is a set of numbers that identifies the USER’s computer on the Internet.

WINDOWS (Pop-Ups): Window or internet warning that automatically emerges at any time when the PLATFORM is used, including the formalization of the Terms and Conditions for the Use of the Platform and the Privacy Policy.

LOGS: records of USER activities carried out on the PLATFORM.

LOCALIE Inc.: is the company that owns and holds all copyrights related to the Internet Platform called Localie.

DATA MESSAGES: The information generated, sent, received, stored or communicated by electronic, optical or similar means. For example: registration forms, Electronic Data Interchange (EDI – Electronic Data Interchange), Internet, electronic mail, chats and other means of communication.

LOCALIE PLATFORM: web and mobile application managed and with exclusive rights to use in Canada by Localie Inc., through which: i) different consumer products are displayed in an advertising form (from Service Providers) so that they can serve as a reference for the Consumer; ii) facilitates the rapprochement between Consumers and Service Providers; iii) it serves as a means of sending communications between the Consumer and LOCALIE Inc. and iv) it can receive payments for purchases directly from the consumer (on behalf of third parties), with the transfer of money to the Service Provider. LOCALIE Inc. does not purchase products on its own, does not store products, nor is it a product seller. It is a technology platform only for intermediating the Sale, charging for the services performed. Also referred to in this Instrument as “PLATFORM”, it can be accessed by computers, notebooks, smartphones or tablets.

SERVICE or SERVICES: Services offered through the PLATFORM.

SESSION ID: identification of the USER session in the registration process or when used in any way on the PLATFORM.

TERMS AND CONDITIONS OF USE OF THE PLATFORM or TERMS OF USE: They constitute the legal terms that regulate the relationship between LOCALIE Inc. and the USERS.

USER: is the natural person using the LOCALIE Platform, identified in this Instrument as USER.

LOCALIE PLATFORM USER: are individuals registered on the Internet Platform called LOCALIE, also called “USER” or “USERS”. LOCALIE and the USER may be referred to individually in this Instrument as “Party” or together as “Parties”.

Obtaining Data and Information

The data and information (whether PERSONAL or ANONYMOUS) will be obtained when the USER: (a) Goes to use the PLATFORM SERVICES; (b) Interact with the various existing tools on the PLATFORM, providing the information voluntarily or involuntarily (in the case of obtaining information on the frequency of use of the PLATFORM or the types of information involved; or (c) Contacting them through the channels communications available on the PLATFORM.

Data and Information Storage

All DATA MESSAGES and information collected from USERS will be incorporated into the PLATFORM DATABASE, with LOCALIE being responsible and owner. The collected data and information will be stored in a safe environment, observing the state of the art available and encrypted, and can only be accessed by qualified and authorized persons by LOCALIE. Considering that no security system is absolutely safe, LOCALIE disclaims any liability for any damages and / or losses arising from failures, viruses or invasions of the DATABASE on the PLATFORM. .

Use of Data and Information

LOCALIE does not rent, sell or share personal information with other people or with non-affiliated companies, except for the purpose of providing the USER with the products and services requested on the platform, having obtained its permission, or in specific circumstances such as court order or arising from law.

In addition, the USER expressly, consciously and voluntarily accepts that his information contained in the LOCALIE databases (personal or anonymous), be compiled, stored for use in the following terms: (i) Collect or collect personal data and incorporate and store them in our database, (ii) Organize, catalog, classify, divide or separate the information delivered, (iii) Use the data provided in communication, dissemination and promotion campaigns or offer products, activities or services developed as part of LOCALIE’s internal strategies, (iv) Use them for internal or commercial administrative purposes such as: credit studies, budget preparation and presentation, commercial experience references, market studies, statistical analysis, performance of surveys on satisfaction, offering or recognizing the benefits of the LOCALIE cashback and loyalty program, as well as in after-sales services, (v) Keep historical records within LOCALIE and maintain contact with USERS, (vi) Verify, prove or validate the data delivered, (vii) Study and analyze the information provided for the monitoring and improvement of products and of the service, (viii) Handing over and transmitting the information collected to third parties with which LOCALIE maintains commercial or storage and administration contracts for personal data, under the standards of security and confidentiality to which LOCALIE is required according to the content of the laws pertinent, (ix) Transmit data at national or international level to suppliers with whom Localie develops activities in accordance with its corporate purpose. Likewise, a transmission can be made to the company’s strategic allies / partners to carry out marketing, advertising and promotions activities associated with the corporate purpose; All of this in accordance with the provisions of Canadian law. E-mails sent by LOCALIE do not contain attachments to be downloaded, nor do they request data from USERS. Thus, credit card data will only be requested when making the virtual payment, and will not be stored by LOCALIE.

Activities Record

LOCALIE may register the activities performed by the USER on the PLATFORM, through LOGS, including: (a) USER’s IP address; (b) Actions performed by the USER on the PLATFORM; (c) Pages accessed by the USER; (d) Dates and times of each action and access to each PLATFORM feature; (e) USER SESSION ID, when applicable. The aforementioned records may be used by LOCALIE in cases of investigation of fraud or undue changes in its systems and registrations, as well as in anonymous sharing with third parties.

Cookies

The PLATFORM may make use of COOKIES, it being up to the USER to configure his Internet browser, in case he wishes to block them. In this case, some features of the PLATFORM may be limited. The USER expressly authorizes, at the time of acceptance of this Privacy Policy, the use of COOKIES by LOCALIE in every use activity that is carried out on the PLATFORM.

User Rights

(i) Know, update and rectify your personal data collected by LOCALIE. This right can be exercised among others in the face of partial, inaccurate, incomplete, fractional or error-inducing data; (ii) Request proof of authorization granted to LOCALIE; (iii) To be informed by Localie, upon previous request, regarding the use that is given to the User’s data; (iv) Submit to the authorities complaints for violations of the provisions of the law; (v) Revoke the authorization and / or deletion of the data at any time, taking into account the legal limits for that purpose; (vi) Have free access to the USER’s registration data contained in the LOCALIE database.

Way of Knowing the Information of the USER and How to Exercise the Rights

Localie presents to the User the choice of the following ways to exercise their “Personal Data” rights:

Electronic service: The User of the data must make his formal request to the electronic address clientservice@localie.ca prior to exhaustion of the legitimation requirements for the exercise of the User, namely:

I. To be the holder of the information, to prove your identity in a sufficient form by any means that Localie intends to do so.

II. By legitimate successors, who must prove this quality.

III. By the representative / empowered of the information holder, who must also prove this quality.

Violation of the Database or System

The use of any device, software, or other resource that may interfere with the activities and operations of LOCALIE, as well as the Offer publications, descriptions, accounts or their databases, is not allowed. Any interference, attempt, or activity that violates or contravenes the laws of intellectual property rights and / or the prohibitions stipulated in this instrument, will make the person liable to the pertinent legal actions, as well as the sanctions provided for herein, being also responsible for the indemnities for any damage caused.

Of the General Provisions

The provisions of this Privacy Policy may be updated or modified at any time, and the USER is responsible for verifying them whenever accessing the PLATFORM.

Applicable Law and Jurisdiction

This Privacy Policy will be interpreted in accordance with Canadian law, in the English language, and the province of Ontario will be elected to resolve any supervening litigation, question or doubt, with the express waiver of any other, however privileged it may be.

Total Acceptance of Terms

The USER declares to have the legal capacity, giving his express CONSENT to the terms contained in this Privacy Policy, being that he accepts all the situations regulated in this document.
